Employment-Based Immigration

  • EB-1 (Employment First Preference)

  • NIW (National Interest Waiver): Applicants distinguished in their professional field or with extraordinary ability may apply for a National Interest Waiver, which waives the standard Labor Certification requirement for most EB immigration petitions: 고학력자 독립 이민으로, 대학교수, 공학자 등의 전문직에서 뛰어난 능력 (미국 국익(national interest)에 도움을 줄 수 있는 경력)을 보유하신 분들이 취업 또는 투자를 할 필요가 없이 미국 영주권을 취득할 수 있도록 하는 제도. 다른 취업이민 2순위와 달리 job offer와 노동국으로부터의 노동인증 (Labor Certification)을 필요로 하지 않는다는 점이 특징

Reentry Permit

  • For U.S. Permanent Residents who wish to continuously reside more than 1 year and less than 2 years outside the United States

  • Applicant must be present in the U.S. at time of filing, and he or she must be in the U.S. to attend the biometrics (fingerprinting) appointment

Special Immigrant Religious Worker (EB-4)

  • Applicant must work for a religious organization or denomination as a minister or in a religious vocation or occupation

  • Applicant must have been a member and an employee of the same religious organization for the immediate 2 years preceding the EB-4 immigration petition

 

Family-Based Immigration

Nonimmigrant Visa


  • 무비자 (ESTA) – Visa Waiver Program

  • • Electronic System for Travel Authorization (ESTA) allows certain visitors to enter the U.S. for business or tourism purposes. However, while a stay of 90 days is allowed, an individual admitted under the Visa Waiver Program cannot extend, change, or adjust status. (The exceptions are spouses and minor children (under 21) of U.S. Citizens)

  • Tourist Visa (B-1/B-2)

  • In general, 6 months stay authorized upon entry, but may file paperwork to change status before the current period expires

  • (E-2) – Treaty Investors

  • For certain foreign nationals, they can start a business in the U.S. under authorized stay.
  • They must be citizens of a treaty country with the United States

  • Student Visa (F-1)

  • For international students wishing to study in the U.S., they must get an I-20 from SEVIS and apply for a student visa or student status. For those changing to student status, they must maintain nonimmigrant status while the F-1 application is pending

  • Professional Work Visa (H-1B)

  • Individuals carrying out a "specialty occupation" requiring at least a bachelor's degree may apply for an H-1B through their sponsor

  • Intra-transferee employees (L-1)

  • Qualifying subsidiary or affiliate company of a foreign country may petition for an L-1 visa for its employee to work in the U.S.

  • Religious Workers (R-1)

  • Individuals working in a religious vocation or occupation may work in the U.S. for a qualifying religious organization or denomination / The individual must have maintained membership within the same denomination for the immediate 2 years

  • Exchange Visitors (J-1)

  • For those visiting for educational, research, or training purposes (Ex: research professors, students, exchange students, etc.)
  • Department of State designates a public or private company to be a sponsor of the J-1 applicant
  • For Examples : Professor / Students, etc

Citizenship/Naturalization

  • Requirements for Naturalization

  • You must be at least 18 years old at the time of filing
  • You have lived in the state of the USCIS District where you make your residence for at least 3 months prior to filing
  • You must have been a U.S. Permanent Resident for at least 5 years (3 years if green card came from marriage to a U.S. Citizen and you are still married to the same spouse for the past 3 years)
  • You have demonstrated physical presence in the U.S. and continuous residence for a required period of time
  • You have Good Moral Character
  • You adhere to the principles and ideals of the U.S. Constitution
  • You have a good basic knowledge of U.S. history and government
  • You have the ability to read, write, speak, and understand basic English (Exceptions apply for certain LPRs)
  • You take an Oath of Allegiance to the United States
